fabarte.org is a domain owned by the Bernard and Almine Ruiz-Picasso Foundation (hereinafter, "FABA"), with registered address in Madrid, calle Diego de León 59; incorporated by deed authorised by the Notary of Madrid, Mr Francisco Javier Cedrón López Guerrero, on 21 June 2002, protocol number 1652; adapted to the current Law 50 /2002 of 26 December 2002, on Foundations by deed authorised by the same Notary, on 22 December 2004, protocol number 2.967; registered in the Register of Cultural Foundations of state competence by Ministerial Order of 28 February 2003 under number 510; registered in the Census of Legal Entities of the Ministry of Economy and Finance with C.I.F. number G-83386508.

I. Copyright

I.1 All the contents of the website, texts, graphics, images, videos, its design and the intellectual property rights that may correspond to said contents, as well as all trademarks, trade names or any other distinctive sign are property of FABA or of their legitimate owners, being reserved all rights over them.

I.2 Any act of total or partial reproduction of the contents of the website, in any form or by any means, as well as any act of dissemination, public communication, provision or distribution, is prohibited without the prior written consent of FABA or its legitimate owners.

I.3 The reproduction, distribution and public communication, including the provision thereof, of all or part of the contents of this website for commercial purposes, on any medium and by any means, are in any case prohibited.

III.1 Users undertake to make appropriate use of the contents and services offered on the site www.fabarte.org in accordance with what is expressed on the website itself, and not to use them for:

i. engage in activities that are unlawful, illegal or contrary to good faith and public policy;

ii. disseminate content or propaganda of a racist, xenophobic, pornographic-illegal, terrorist or harmful to human rights nature;

iii. cause damage to the systems of FABA, its suppliers or third parties;

iv. introduce or disseminate computer viruses or any other physical or logical systems that could cause such damage; and/or attempt to access and, where appropriate, use the e-mail accounts of other users and modify or manipulate their messages.

III.2 FABA shall not be held responsible for the opinions expressed by users through forums or other participation tools that may be developed regarding the Foundation's activity or the content of this website.

IV. Modifications

FABA reserves the right to modify, unilaterally and without prior notice, the provision, configuration and content of this website, in whole or in part, as well as its conditions of use and access to the services provided.

V. Applicable law and competent jurisdiction

These conditions of use are governed by Spanish law. All disputes that may arise from their interpretation, application and compliance shall be submitted to the Courts and Tribunals of Madrid (Spain), and the parties expressly waive any other jurisdiction to which they may be entitled.
